www.nateperkins.tv/ By Eric Stirgus The Atlanta Journal-Constitution Thursday, November 13, 2008 Atlanta Mayor Shirley Franklin said Wednesday the citys employees will have their hours - and pay - cut by 10 percent each week to help the city weather an expected budget shortfall of $50 million to $60 million. The pay and hour cuts, which begin Dec. 1, affect 4,600 city employees. Franklin also announced an immediate hiring freeze for most city agencies and said the city will have to cut back some services, dip into its reserves for about $12 million and make other personnel moves.
Blaming the shortfall on the nations economic crisis, Franklin said the city needs a federal rescue plan in addition to its cuts to balance the budget. In a letter Tuesday to U.S. Rep. Charles Rangel (D-N.Y.), chairman of the House Ways and Means Committee, she asked for federal investment in Atlantas - and other cities - infrastructure, public safety, and programs for job training and placement.
The future prosperity of this country is tied directly to our ability to provide basic services and quality infrastructure to our citizens, Franklin wrote. We are at serious risk in failing in that most basic public responsibility. And if current economic conditions continue, she told the City Councils Finance/Executive committee, This will not be the last time you see me before the end of the fiscal year. Although Franklin and her staff said they have not made decisions about how they will make the service cuts, some union leaders said the changes will erode morale and threaten public safety.
This is a dangerous time for our firefighters, Atlanta fire Lt. Jim Daws, president of the International Association of Fire Fighters, Local 134, told reporters. The city is putting them in a dangerous position. Atlanta police Sgt. Scott Kreher, president of the International Brotherhood of Police Officers, Local 623, said some officers may get discouraged by the cuts and leave the force.
The citizens of Atlanta should be screaming at the top of their lungs, he said. But Franklin, pointing to data showing crime in Atlanta is down in most major categories this year, said Atlantans are going to have a safe city. Councilman Ceasar Mitchell proposed furloughs earlier this year. City leaders did not approve the idea. We are in a deep, wide recession. We are going to provide the best services we can with the resources we have, the mayor said.
Franklin and her staff based the projected shortfall on data showing revenues below projections for the first three months of the current budget year, which began July 1. Sales taxes, which represent about 20 percent of the citys revenue, are down by 3 percent. Building permit and licensing permit revenues are down 60 percent and 50 percent respectively.
Franklin said the citys expenses are 2 percent below budget. She said the citys Aviation Department, which manages Hartsfield-Jackson International Airport, is holding up, but its Watershed Management Department is facing a projected budget shortfall of at least $50 million. City officials say the shortfall is caused largely by dropoffs in usage revenues and rising debt costs, and the mayor said Watershed Management officials are working on a plan to meet the gap.
Some city residents wondered Wednesday whether the cuts were being made too hastily. Paul Zucca of Grant Park noted the city last week hired a new chief financial officer and consultants to create a long-term plan to improve the citys Finance Department. I would feel more comfortable when the chief financial officer has more numbers, said Zucca, who served on a committee that recently came up with salary recommendations for the mayor, City Council and Atlanta Board of Education. Councilman Kwanza Hall, vice chairman of the councils finance committee, countered that the city had to move quickly. I appreciate [Franklins staff] doing it now instead of waiting until later, he said.
The city earlier this year laid off 372 employees, eliminated about 900 jobs, cut some services and raised fees to fill a $140 million budget gap for the current fiscal year. Atlanta had a $41 million budget deficit for the fiscal year that ended June 30. Nutter delivered the letter to Treasury Secretary Henry Paulson. NATEPERKINS.TV: U.S. Supreme Court "Denies Troy Davis̢۪ Execution"
The United States Supreme Court has issued a stay of execution to stop, at least for the time being, the State-mandated murder of Troy Davis.
The State of Georgia was planning to murder Troy Davis about an hour ago. They were planning to do so even though his conviction was based entirely on the testimony of nine eye-witnesses, seven of whom have since recanted their testimony and claimed that they were intimidated into giving false testimony by threats from the cops. Neither physical evidence nor a murder weapon was ever produced by the police. But the Georgia Board of Paroles and Pardons refused to give Davis a new evidentiary hearing, to investigate whether or not this man was about to be murdered based on nothing but lies, because a mans life means nothing next to the importance of finality in the States criminal system. Yesterday the Georgia Supreme Court refused to stay the execution because, in their view, U.S. Supreme Court properly has jurisdiction over Davis pending petition, and a mans life means nothing next to the importance of due deference to another judges turf. Never mind that, under normal circumstances, the U.S. Supreme Court would not even have been ready to hear Troy Daviss plea for a new evidentiary hearing until after the State of Georgia killed Davis. Thankfully, after agreeing to an emergency hearing, the Supreme Court did the right thing and put a halt to the killing, at least until after Daviss petition can be heard.
JACKSON, Georgia (CNN) The U.S. Supreme Court granted a last-minute reprieve to a Georgia man fewer than two hours before he was to be executed for the 1989 slaying of an off-duty police officer. Troy Anthony Davis, 39, has his execution stayed by the U.S. Supreme Court on Tuesday.
Troy Anthony Davis learned that his execution had been stayed when he saw it on television, he told CNN via telephone in his first interview after the stay was announced.
He said he was thankful to God for the news that came during an emergency session the U.S. Supreme Court convened.
Davis said everyone should pray for the slain officers family.
The 39-year-old also said that he is very grateful for everything that everyone is doing for him and that he would accept whatever decision the Supreme Court rendered in the coming days about his case.
At the Diagnostic and Classification Prison in Jackson, a crowd of Davis supporters, led by the Rev. Al Sharpton, erupted in cheers when Sharpton announced the stay. Some shouted Hallelujah!

ATLANTA (AP) After a Georgia inmate convicted of murdering a police officer was spared from execution a second time, the condemned man's widely publicized supporters erupted in joy. But far from television cameras, the victim's family seethed.
"My son is dead. Theirs is still alive," said Anneliese MacPhail, the officer's mother. "That's just the way I feel."
Arm-in-arm with the Rev. Al Sharpton, Troy Davis' exultant family and a busload of supporters sang, wept and prayed Tuesday when they learned he was granted a temporary reprieve from the U.S. Supreme Court just hours before he was to be executed.
It was the second time he had been spared and, for Davis' family, another opportunity to proclaim his innocence and press for a new trial. The execution will be delayed for at least a couple of weeks. The court is scheduled to review Davis' appeal at a private conference on Monday.
Away from the spotlight was the grieving family of Mark MacPhail, who was shot and killed in 1989 while moonlighting as a security guard at a Savannah bus station. He rushed to help a homeless man who had been pistol-whipped and was shot twice when he approached Davis and two other men.
Embittered by delays and legal maneuvering, the family was devastated by Tuesday's reprieve.
"I'm furious, disgusted and disappointed," Anneliese MacPhail said. "I want this over with. This has been hanging over us for 19 years."
Davis was convicted in 1991, after prosecutors at his trial said he approached McPhail with a "smirk on his face" as he fired the gun. But seven of the nine key witnesses who helped put Davis on death row have since recanted their statements. Three other people have said one of the witnesses who testified at Davis' trial later confessed to killing the officer.
The fresh doubts, coupled with Davis' claims of innocence, have drawn support from high-profile leaders like President Jimmy Carter and South Africa Archbishop Desmond Tutu. Amnesty International has organized protests as far away as Paris, and Sharpton has helped lead rallies calling for a new trial.
Amid the concerns, the state pardons board postponed Davis' execution in July 2007 less than 24 hours before it was to occur. The courts have since thoroughly vetted the case.
A divided Georgia Supreme Court this year has twice rejected his request for a new trial, and the pardons board turned down his bid for clemency this month after considering the case again.
The U.S. Supreme Court issued its last-minute stay Tuesday night after Davis had already turned down his last meal and prepared his final statement.
For MacPhail's family, the lengthy appeals process has been excruciating.
"If I saw him, I'd punch him in the face," the victim's mother said of Davis. "I am angry at the whole family. I don't know how they have such a following."
Mark MacPhail was an Army Ranger for almost six years before he and his wife decided to settle down and he became a police officer in Savannah.
To his 74-year-old mother, who sat through the trial and becomes livid when she talks about the case, there's no question that Davis pulled the trigger.
"I don't think there will ever be closure. There's a hole in our heart that will never be healed," she said. "But we just want Mark to rest in peace. And we want to live now. We have just been existing all these years, waiting for the next shoe to drop.
"When it's over, justice has been done. That's the way we feel."

New York civil rights activist Al Sharpton said condemned cop killer Troy Anthony Davis was surprisingly upbeat Saturday night after the two prayed together on Georgias death row.
He was not overly optimistic or pessimistic, said the Rev. Sharpton, who visited Davis on death row at Georgia Diagnostic and Classification Prison in Jackson at the request of Davis family. He was suprisingly upbeat. He seemed like he was depending on his faith to see him through.
Sharpton has joined a growing chorus of prominent figures calling for Georgia to spare the life of the 39-year-old, who is scheduled to be executed by lethal injection Tuesday night for the 1989 murder of Savannah police Officer Mark Allen MacPhail.
If you have this kind of wide array of people who dont agree on much, but who believe that clemency is needed in this case, that should impress upon [the Georgia State Pardons and Parole Board] to give him another opportunity to show that there is not reasonable doubt, Sharpton said.
But Scheree Lipscomb, a spokeswoman for the Pardons and Parole Board, said Saturday night there would be no last-minute clemency.
The board members have considered clemency on two occasions, Lipscomb said. They stand firm in the decision that they have made.
Both former President Jimmy Carter and Bob Barr, a Libertarian Party presidential candidate and former Georgia congressman, on Friday asked the board to grant Davis a stay of execution.
Barr wrote a letter to the parole board last week asking it to reconsider the Davis case because, he wrote, the doubts about the Davis case have not been resolved, and fears that Georgia might execute an innocent man have not been allayed.
Carter issued a statement Friday asking the parole board to reconsider the case, saying it illustrates the deep flaws in the application of the death penalty in this country.
Carter wrote that executing Troy Davis without a real examination of potentially exonerating evidence risks taking the life of an innocent man and would be a grave miscarriage of justice.
Georgians for Alternatives to the Death Penalty and the NAACP said Saturday they are planning another rally at 11 a.m. Monday in front of the State Capitol to urge the parole board to reconsider or the state Supreme Court to stay the execution of Davis while his case is appealed to the U.S. Supreme Court.
Davis is convicted of killing MacPhail, on Aug. 19, 1989. Since Davis 1991 trial, several key witnesses have recanted their testimony. Witness testimony formed the core of the prosecutions case because physical evidence was scant: no murder weapon, no fingerprints, no DNA.
The case has attracted worldwide attention, with calls to stop his execution from Pope Benedict XVI, Amnesty International and Nobel Peace Prize-winner Desmond Tutu. Rallies have been held as far away as Paris.
Officer MacPhails mother, Anneliese MacPhail, 74, of Columbus, said Saturday she is disgusted by the outpouring of support for Davis. Its tearing me apart to see my sons name dragged through the mud because of all of this.
She said she had no doubt Davis is guilty. I hope this is over Tuesday and I can have some peace, she said.
She will not attend the scheduled execution, but three of my children will be in Jackson, she said.

To many Atlantans and tourists, Barbara Asher Square is a slice of city life that is not appealing. There's panhandling. Drug dealing. Marijuana smoking. Profanity. Fighting.
The city has an estimated 7,000-12,000 homeless, most of them African-American men, according to Crossroads Community Ministries, which works to move Atlanta's homeless of the streets and toward self-sufficiency.
Some supporters of the ordinance said it is not directed at all homeless people. "I'm just asking that the council separates their good and legitimate concern for homeless people from the ban on offensive, aggressive panhandling," said Jones of Georgia State.
So it was Monday that a City Council hearing on a proposal to limit begging in parts of downtown carried a special resonance. The fiery, revival-style meeting exposed raw passions that led to accusations of racism and elitism by the proposal's opponents and charges by its supporters that some of the most aggressive beggars aren't even homeless.
Opponents said the proposal is mean-spirited. "Why do we need to keep on criminalizing people who are poor?" asked Atlanta resident Steve Carr.
Clarence Davis, who is homeless, invoked the Bible: "All through the Bible, they were begging. Begging was way back there in the Bible days."
Robinson of Central Atlanta Progress said the proposal is aimed at "about 100 hard-core, aggressive panhandlers" who aren't even homeless.
Indeed, Stoops said, panhandlers are not necessarily homeless. But he said ordinances fail to address the larger circumstances that may prompt people to panhandle.
"Making it illegal to panhandle is not the solution," he said. "Maybe we should ask why someone is on the streets begging for spare change in the first place."
On Wednesday, Atlanta police began what they say will be an "indefinite" crackdown at the square, located near the Five Points MARTA station. Asher Square is a pedestrian walkway in downtown Atlanta that connects the central Five Points MARTA station to Broad Street. It's narrow with tall offices on either side and often catches a breeze, making it a good place to sit outside if you're gonna sit outside all day.
I see their point about the bad element - a lot of street people hang out here and sell drugs, I've smelled pot in the middle of the day, and if you don't know how to deal with panhandlers it can be intimidating.
This crackdown is clearly all about image, though. Asher Square was one of the more pleasant places for street people to sit around. The people who are displaced from Asher will go around the block and hang out in already overcrowded and much sunnier Woodruff Park. I worry about the vibrancy of Atlanta's street life - Asher usually had two or three vendor carts, a couple buskers, and some street preachers, including the locally famous Preacher Love.
Asher isn't that big - two cops could observe the whole area, and regular bike cop patrols from the two police stations just blocks away could do a lot to cut down on crime. Are the APD just lazy? Or is this a bone for the bitchy office workers who have to deal with the area for a whole five minutes on their way to work?

Williams said he crafted an idea for a 30-day blitz on panhandlers to help root out the problem.
In interviews earlier in August, hospitality officials said City Hall, hospitality leaders and Atlanta police were quietly launching a new initiative to curtail aggressive panhandling, which officials say makes visitors feel unsafe and hurts efforts to attract tourism and business, particularly to downtown.
The effort involves an increase in law enforcement presence including the use of undercover officers increasing the involvement of downtown business owners in combating the problem and educating the public about aggressive panhandlers tactics, police and tourism officials said.
An August 2005 law banned verbal requests for money in certain locations downtown. The ordinance also made it illegal citywide to panhandle after dark or near places like ATMs and pay phones. Punishment goes on a sliding scale from a warning on first offense, to referral to a resource center on a second offense, and up to one-month confinement for additional offenses.
The city has had some difficulty prosecuting panhandlers because of a lack of witnesses. Victims often are visitors to the city and cannot be counted on to testify at trial. Using undercover officers allows for ready-made witnesses, police have said.
Though the 30-day blitz by undercover officers is nearly completed, Williams said officers would not back down, and undercover stings will be ongoing.

Google the corner of Marietta and Broad, and check it out in street view. You can see Asher Square in a relatively unbusy period, and if you look at the corner of Peachtree and Walton you can see Woodruff Park completely empty in what appears to be a cold fall evening. Normally that gazebo corner with the statue in Woodruff would be completely full of people playing cards or trying to sell stuff.

Barack Obamas campaign has just moved its Oprah event on Sunday from an arena in Columbia seating 18,000 to a football stadium with a capacity of more than 80,000.
Tickets, which are free, went quickly on Monday, when they were first available, and the campaign had to shut down its distribution system. Now, the campaign says, tickets arent even necessary, although it hopes people will RSVP through its Web site.
The new venue is Williams-Brice Stadium at the University of South Carolina. Doors open at 12:30 p.m., Eastern and the event starts at 2:30 p.m.
