Ga. officer's family angered by execution delay

ATLANTA (AP) After a Georgia inmate convicted of murdering a police officer was spared from execution a second time, the condemned man's widely publicized supporters erupted in joy. But far from television cameras, the victim's family seethed.

"My son is dead. Theirs is still alive," said Anneliese MacPhail, the officer's mother. "That's just the way I feel."

Arm-in-arm with the Rev. Al Sharpton, Troy Davis' exultant family and a busload of supporters sang, wept and prayed Tuesday when they learned he was granted a temporary reprieve from the U.S. Supreme Court just hours before he was to be executed.

It was the second time he had been spared and, for Davis' family, another opportunity to proclaim his innocence and press for a new trial. The execution will be delayed for at least a couple of weeks. The court is scheduled to review Davis' appeal at a private conference on Monday.

Away from the spotlight was the grieving family of Mark MacPhail, who was shot and killed in 1989 while moonlighting as a security guard at a Savannah bus station. He rushed to help a homeless man who had been pistol-whipped and was shot twice when he approached Davis and two other men.

Embittered by delays and legal maneuvering, the family was devastated by Tuesday's reprieve.

"I'm furious, disgusted and disappointed," Anneliese MacPhail said. "I want this over with. This has been hanging over us for 19 years."

Davis was convicted in 1991, after prosecutors at his trial said he approached McPhail with a "smirk on his face" as he fired the gun. But seven of the nine key witnesses who helped put Davis on death row have since recanted their statements. Three other people have said one of the witnesses who testified at Davis' trial later confessed to killing the officer.

The fresh doubts, coupled with Davis' claims of innocence, have drawn support from high-profile leaders like President Jimmy Carter and South Africa Archbishop Desmond Tutu. Amnesty International has organized protests as far away as Paris, and Sharpton has helped lead rallies calling for a new trial.

Amid the concerns, the state pardons board postponed Davis' execution in July 2007 less than 24 hours before it was to occur. The courts have since thoroughly vetted the case.

A divided Georgia Supreme Court this year has twice rejected his request for a new trial, and the pardons board turned down his bid for clemency this month after considering the case again.

The U.S. Supreme Court issued its last-minute stay Tuesday night after Davis had already turned down his last meal and prepared his final statement.

For MacPhail's family, the lengthy appeals process has been excruciating.

"If I saw him, I'd punch him in the face," the victim's mother said of Davis. "I am angry at the whole family. I don't know how they have such a following."

Mark MacPhail was an Army Ranger for almost six years before he and his wife decided to settle down and he became a police officer in Savannah.

To his 74-year-old mother, who sat through the trial and becomes livid when she talks about the case, there's no question that Davis pulled the trigger.

"I don't think there will ever be closure. There's a hole in our heart that will never be healed," she said. "But we just want Mark to rest in peace. And we want to live now. We have just been existing all these years, waiting for the next shoe to drop.

"When it's over, justice has been done. That's the way we feel."

New York civil rights activist Al Sharpton said condemned cop killer Troy Anthony Davis was surprisingly upbeat Saturday night after the two prayed together on Georgias death row.

He was not overly optimistic or pessimistic, said the Rev. Sharpton, who visited Davis on death row at Georgia Diagnostic and Classification Prison in Jackson at the request of Davis family. He was suprisingly upbeat. He seemed like he was depending on his faith to see him through.

Sharpton has joined a growing chorus of prominent figures calling for Georgia to spare the life of the 39-year-old, who is scheduled to be executed by lethal injection Tuesday night for the 1989 murder of Savannah police Officer Mark Allen MacPhail.

If you have this kind of wide array of people who dont agree on much, but who believe that clemency is needed in this case, that should impress upon [the Georgia State Pardons and Parole Board] to give him another opportunity to show that there is not reasonable doubt, Sharpton said.

But Scheree Lipscomb, a spokeswoman for the Pardons and Parole Board, said Saturday night there would be no last-minute clemency.

The board members have considered clemency on two occasions, Lipscomb said. They stand firm in the decision that they have made.

Both former President Jimmy Carter and Bob Barr, a Libertarian Party presidential candidate and former Georgia congressman, on Friday asked the board to grant Davis a stay of execution.

Barr wrote a letter to the parole board last week asking it to reconsider the Davis case because, he wrote, the doubts about the Davis case have not been resolved, and fears that Georgia might execute an innocent man have not been allayed.

Carter issued a statement Friday asking the parole board to reconsider the case, saying it illustrates the deep flaws in the application of the death penalty in this country.

Carter wrote that executing Troy Davis without a real examination of potentially exonerating evidence risks taking the life of an innocent man and would be a grave miscarriage of justice.

Georgians for Alternatives to the Death Penalty and the NAACP said Saturday they are planning another rally at 11 a.m. Monday in front of the State Capitol to urge the parole board to reconsider or the state Supreme Court to stay the execution of Davis while his case is appealed to the U.S. Supreme Court.

Davis is convicted of killing MacPhail, on Aug. 19, 1989. Since Davis 1991 trial, several key witnesses have recanted their testimony. Witness testimony formed the core of the prosecutions case because physical evidence was scant: no murder weapon, no fingerprints, no DNA.

The case has attracted worldwide attention, with calls to stop his execution from Pope Benedict XVI, Amnesty International and Nobel Peace Prize-winner Desmond Tutu. Rallies have been held as far away as Paris.

Officer MacPhails mother, Anneliese MacPhail, 74, of Columbus, said Saturday she is disgusted by the outpouring of support for Davis. Its tearing me apart to see my sons name dragged through the mud because of all of this.

She said she had no doubt Davis is guilty. I hope this is over Tuesday and I can have some peace, she said.

She will not attend the scheduled execution, but three of my children will be in Jackson, she said.

GFADP also plans a vigil outside the Jackson jail, as well as a protest on the Capitol steps, both to begin at 6:30 p.m. Tuesday.

Sharpton spent about 35 minutes with Davis on Saturday night, and said by phone that the death-row inmate reflected on how he became a murder suspect.

He said he got in with the wrong crowd and thought one of the guys he was hanging with killed [MacPhail], Sharpton said. He said young people should be careful who they hang around.

To many Atlantans and tourists, Barbara Asher Square is a slice of city life that is not appealing. There's panhandling. Drug dealing. Marijuana smoking. Profanity. Fighting.

The city has an estimated 7,000-12,000 homeless, most of them African-American men, according to Crossroads Community Ministries, which works to move Atlanta's homeless of the streets and toward self-sufficiency.

Some supporters of the ordinance said it is not directed at all homeless people. "I'm just asking that the council separates their good and legitimate concern for homeless people from the ban on offensive, aggressive panhandling," said Jones of Georgia State.

So it was Monday that a City Council hearing on a proposal to limit begging in parts of downtown carried a special resonance. The fiery, revival-style meeting exposed raw passions that led to accusations of racism and elitism by the proposal's opponents and charges by its supporters that some of the most aggressive beggars aren't even homeless.

Opponents said the proposal is mean-spirited. "Why do we need to keep on criminalizing people who are poor?" asked Atlanta resident Steve Carr.

Clarence Davis, who is homeless, invoked the Bible: "All through the Bible, they were begging. Begging was way back there in the Bible days."

Robinson of Central Atlanta Progress said the proposal is aimed at "about 100 hard-core, aggressive panhandlers" who aren't even homeless.

Indeed, Stoops said, panhandlers are not necessarily homeless. But he said ordinances fail to address the larger circumstances that may prompt people to panhandle.

"Making it illegal to panhandle is not the solution," he said. "Maybe we should ask why someone is on the streets begging for spare change in the first place."

On Wednesday, Atlanta police began what they say will be an "indefinite" crackdown at the square, located near the Five Points MARTA station. Asher Square is a pedestrian walkway in downtown Atlanta that connects the central Five Points MARTA station to Broad Street. It's narrow with tall offices on either side and often catches a breeze, making it a good place to sit outside if you're gonna sit outside all day.

I see their point about the bad element - a lot of street people hang out here and sell drugs, I've smelled pot in the middle of the day, and if you don't know how to deal with panhandlers it can be intimidating.

This crackdown is clearly all about image, though. Asher Square was one of the more pleasant places for street people to sit around. The people who are displaced from Asher will go around the block and hang out in already overcrowded and much sunnier Woodruff Park. I worry about the vibrancy of Atlanta's street life - Asher usually had two or three vendor carts, a couple buskers, and some street preachers, including the locally famous Preacher Love.

Asher isn't that big - two cops could observe the whole area, and regular bike cop patrols from the two police stations just blocks away could do a lot to cut down on crime. Are the APD just lazy? Or is this a bone for the bitchy office workers who have to deal with the area for a whole five minutes on their way to work?

    Williams said his office has been inundated with complaints about panhandling since he became the commander of Zone 5 in June. Williams said he crafted an idea for a 30-day blitz on panhandlers to help root out the problem.

    In interviews earlier in August, hospitality officials said City Hall, hospitality leaders and Atlanta police were quietly launching a new initiative to curtail aggressive panhandling, which officials say makes visitors feel unsafe and hurts efforts to attract tourism and business, particularly to downtown.

    The effort involves an increase in law enforcement presence including the use of undercover officers increasing the involvement of downtown business owners in combating the problem and educating the public about aggressive panhandlers tactics, police and tourism officials said.

    An August 2005 law banned verbal requests for money in certain locations downtown. The ordinance also made it illegal citywide to panhandle after dark or near places like ATMs and pay phones. Punishment goes on a sliding scale from a warning on first offense, to referral to a resource center on a second offense, and up to one-month confinement for additional offenses.

    The city has had some difficulty prosecuting panhandlers because of a lack of witnesses. Victims often are visitors to the city and cannot be counted on to testify at trial. Using undercover officers allows for ready-made witnesses, police have said.

    Though the 30-day blitz by undercover officers is nearly completed, Williams said officers would not back down, and undercover stings will be ongoing.

    Having worked some with homeless people, many won't go to shelters. Also shelters now do drug testing and turn people away. Many on the street are mentally ill. It is definitely a problem. At the corner of North Ave. and W. Peachtree by All Saints Episcopal church, it is a daily problem.

These people sleep under bridges and have no place to go - if you had nothing, no resources, no hope -you would panhandle too! I think the city needs to work on the source of the issue instead of continuing to arrest these poor people who need a hand up. The "problem" is not panhandling - panhandling is a result of the homeless issue in ATL - that is the "problem" that we must address. Mrs. Mayor????

    I applaud the effort, but more areas of the city are dealing with this problem than just downtown. My fear is that this "sting" operation will just shift the problem from one police precinct to another.

    I applaud the effort. Now if they would force 378 Peachtree, LLC to clean up that building at the corner of Ivan Allen and Peachtree, the panhandlers wouldn't have such a convenient place to sleep (even closer than P'tree and Pine) and maybe they would move on.

    Well I hope it works and it is not just another P.R. Move. As I set here at the corner bakery( Peachtree & Baker ) every day you can see the same old crew harass the locals ( particularly the women ) and of course scare the wits out of those going down Baker to the Aquarium from Peachtree -the police can only do so much -get rid of the Pine Street problem -and vote out of office those judges who don't have to put up with the problem. Ban the ones from downtown who have two arrests at the same location.

    Woodruff Park is 500 feet from Asher Square.

    Google the corner of Marietta and Broad, and check it out in street view. You can see Asher Square in a relatively unbusy period, and if you look at the corner of Peachtree and Walton you can see Woodruff Park completely empty in what appears to be a cold fall evening. Normally that gazebo corner with the statue in Woodruff would be completely full of people playing cards or trying to sell stuff.

We Need a Good Whuppin -- November 2004

0 No doubt you have memories of your parents giving you what we called a whuppin. You probably thought they were mean and didnt love you, right? Your parents, on the other hand, probably felt terrible too, even though you deserved that whuppin they didnt want to see you hurt, and they surely didnt want to be the ones to inflict the pain. Its the same way today with us as adult Black people. Our elders, which I have officially joined, as of August 2004, love us and do not want to see us hurt, but they need to give us a good whuppin every now and then.

In my frustration, not only after the voting irregularities in the 2004 election, I pulled out a cassette tape I bought four years ago, right after that last presidential selection. It was recorded by an elder whom I love and highly respect. His name is Kwa David Whitaker, of Cleveland, Ohio. The presentation on the tape is titled, The Wake Up Call. I am telling you right now, you must get a copy of this brothers discourse.

Brother Whitaker recorded his insightful, enlightening, and prophetic words in November 2000. He expertly weaved the Gore/Bush election scenario into an easy-to-understand football analogy, explained what position Black folks are in vis-à-vis the U.S. political system, and told us how to win, despite the system being stacked against us. When I first heard it, I called Kwa David and thanked him for turning out such a fantastic piece of communication to our people. I then bought several copies of the tape and gave them to others.

No one loves Black people more than Kwa David, but I know hed rather whup us than to see someone else do it. So, how about another one, Bro? I dont believe there has ever been a time that Black people in this country have been so dysfunctional, so apathetic, so gullible, so afraid, so irresolute, so unconcerned, so lemming-like, and so willing to capitulate to the whims and desires of every other group, while turning our backs on the interests and needs of our own people.

In Cincinnati, I see black folks selling their souls to an inept, corrupt, and biased political administration. I see them acquiesce to greedy power-hungry corporate executives, denying Black people even the slightest opportunity for collective economic advancement.

I have seen it all in this city, and it is getting worse. We have ignorant, cowering, volunteer-slave blacks who have been chosen to do the bidding of the establishment, and they do it with the pride and aplomb of a Colin Powell, Armstrong Williams, or Condoleezza Rice. No, let me make that Clarence Thomas.

Yes, we need a good whuppin, and I hope it starts right here in Cincinnati, Ohio, and moves out from here, because as Kweisi Mfume said in reference to the boycott of this city, this is ground zero. He also said, 'If [racial discrimination and mistreatment] are not solved here, they won't be solved anywhere. Tell that to Dick Gregory and Bev Smith, who are scheduled to break the boycott of Cincinnati, and all the other black entertainers who have already broken it. Good luck, Mfume.

Kwa Davids Wake Up call was apropos in 2000, and it is even more apropos in 2004, except now it must be accompanied by a good whuppin. Remember how you wouldnt get out of bed when your parents called you in the morning? Remember what happened when they stopped calling? They started whuppin you out of the bed Well, thats what we need now Brother Whitaker.

Whup us until we stop relying on weak, ignorant, uninformed talking heads on radio and television for our directional information. They are flunkies and lackeys, and will say whatever they think will put them in good stead with someone elses checkbook. Give me more of Tom Pope, Cliff Kelley, and other Black talk show hosts who are unafraid and will not compromise the economic future of their own people.

Whup us until we stop sitting back and taking the injustice of a racist police department, such as the one in Cincinnati. Whup us until we stop consenting to economic apartheid and exclusion, such as what we have in Cincinnati. Whup us until we no longer accept the corrupt voting systems, such as the ones we experienced in Cincinnati and around Ohio.

Whup us until we stand up like Black men and women and do what we must for ourselves and for our children. Whup us until we wake up, get up, stand up, and start fighting back. Until then, keep whuppin us because we need a good whuppin.

Tinseltown's triumphs are reflected in this year's Celebrity 100, Forbes' annual list of the world's most powerful and best-paid celebrities. To generate the list, Forbes analyzes celebrity earnings, plus media metrics like Google hits, press mentions as compiled by Lexis/Nexis, TV and radio mentions from Factiva and the number of times an A-lister appears on the cover of 32 major consumer magazines.

Barack Obamas campaign has just moved its Oprah event on Sunday from an arena in Columbia seating 18,000 to a football stadium with a capacity of more than 80,000.

Tickets, which are free, went quickly on Monday, when they were first available, and the campaign had to shut down its distribution system. Now, the campaign says, tickets arent even necessary, although it hopes people will RSVP through its Web site.

The new venue is Williams-Brice Stadium at the University of South Carolina. Doors open at 12:30 p.m., Eastern and the event starts at 2:30 p.m.

ATLANTA (AP) Grammy-winning rapper T.I. was arrested just hours before he was to take the stage at the BET Hip-Hop Awards after federal officials said he had paid his bodyguard to buy machine guns and silencers for him.

The self-proclaimed King of the South, who was up for nine nominations, won two awards. But he couldn't accept any trophies or make the planned performance after being arrested by federal authorities early Saturday.

T.I. was taken into custody in a shopping center parking lot where federal officials said he planned to pick up machine guns and silencers he had his bodyguard buy for him.

The arrest Saturday resulted from an investigation that began this month when a federal firearms licensee contacted the Bureau of Alcohol, Tobacco, Firearms and Explosives about a man inquiring about buying a machine gun without registering the weapon as required by law, according to a criminal complaint filed Saturday in U.S. District Court in Atlanta.

After trying to buy several machine guns from an undercover ATF agent, the unnamed person began cooperating with the government and said he was buying the machine guns and silencers for Clifford Harris, T.I.'s given name, the complaint said. According to the bodyguard, he had bought about nine firearms for T.I., and the rapper had given him cash to buy guns four different times, it said.

Harris brokered the deals through the bodyguard because he is a convicted felon, the complaint alleged. It is against federal law for a convicted felon to have another person get firearms on their behalf.

The 27-year-old rapper had arranged to pick up the weapons just hours before he was to take the stage at the Hip-Hop Awards, being taped blocks away, according to the complaint.

Sydney Margetson, a spokesman for T.I.'s label, Atlantic Records, declined to comment Saturday.

As the Hip-Hop Awards were being taped in Atlanta on Saturday night, federal authorities were searching T.I.'s home in East Point, about 15 miles southwest of the city.

Half a dozen agents were still searching well into the night, removing boxes and envelopes from the large, red brick house with white columns and ornate glass windows, removing boxes and envelopes.

T.I. had been expected to perform at the BET show, which is to be broadcast Wednesday, and was nominated in nine categories. Instead, the rapper was noticeably absent from red carpet festivities before the show began at 6 p.m., though he was at the center where the show was to be taped.

Saturday was supposed to be a day of revelry for T.I., the co-chief executive of Grand Hustle Records. The self-proclaimed King of the South won three awards at last year's inaugural BET Hip-Hop Awards and received nine nominations this year, including CD of the Year, Lyricist of the Year and MVP of the Year.

Even though the Atlanta-based rapper was present at the Civic Center, where the event was held, he became noticeably absent from the red carpet festivities before the show.

The news of T.I. being arrested rippled throughout the event. Rapper KRS-One, who received BET's "I am Hip Hop" Icon Award, learned about the raid just before he showed up.

KRS-One, whose real name is Lawrence Parker, said the fellow rapper's legal woes should not reflect on the industry as a whole.

"I'm saddened anytime I hear of a hip-hopper being locked up or somehow stunted in his life or his growth," he told The Associated Press. "I hope he wasn't into nothing crazy."

Chicago rapper Common, who won the CD of the year award along with T.I., tried to lend his support.

"I salute my guy T.I., who also won, wherever he is," said Common, while raising up his trophy. He also won lyricist of the year.

Other artists who were supposed to perform with T.I. still pulled off the performance. As Wyclef Jean stood on stage to enact T.I.'s song, "You Know What It Is," host and comedian Katt Williams pranced across the stage dressed like T.I. trying to impersonate him as the crowd burst into laughter.

Alfamega still took the stage with Busta Rhymes for the song "Hurt." As the two rapped, many of the audience members stood seemingly puzzled at T.I.'s absence.

Kanye West was a winner in two categories best live performance and hip-hop video. After West got his trophy for best hip-hop video, he said he thought the video for UGK's "International Players," featuring OutKast, should have been chosen over his.

"I didn't deserve this award above them. They do instead of me," said West, who is typically known more for comments that critics call arrogant.

But Big Boi of OutKast returned the favor to West by giving him the award back saying, "You worked too hard for this. No, you deserve it."

The Hip Hop Awards will air on Oct. 17.

T.I.'s sixth album, T.I. vs. T.I.P., was released July 3 and debuted at No. 1.

In May 2006, T.I.'s best friend, Philant Johnson, was killed and three others were injured in a gun shootout after a post-performance party in Cincinnati. The killer remains at large, and T.I. was briefly locked up a few days after the funeral on suspicion of failing to perform community service stemming from a 2003 arrest.

T.I. grew up in Atlanta and was selling crack by the time he was a teenager. After years of hustling to launch his rap career, recording demos and flying back and forth to New York shopping for a record deal, his first taste of success came with his 2003 album, Trap Muzik.

But the next year, warrants were issued for his arrest on probation violations for a drug conviction, and he was sentenced to three years behind bars. It wasn't clear Saturday how much of the sentence he actually served.

T.I. hit the big screen in his debut movie, ATL, in March 2006. He has a role opposite Academy Award winners Denzel Washington and Russell Crowe in American Gangster, set for release Nov. 2.
